When an employee’s mental health generates a workplace challenge, tribal employers typically engage in a meaningful conversation to determine whether the employer can accommodate the employee’s needs while holding employees accountable to the workplace standards. This arena is complicated by the question of whether federal and state standards apply and when they do not, how should the tribal sovereign shape its standards.
